These Terms of Use and Sale (“Terms”) govern your access to and use of joiedejade.com, including its online store, content, features, and related services collectively, the “Site.”
The Site is owned and operated by joie de Jade LLC, doing business as joie de Jade (“joie de Jade,” “we,” “us,” or “our”).
By accessing the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and any product-specific terms presented before purchase. If you do not agree, please do not use the Site.
1. Eligibility
To make a purchase, you must be at least eighteen years old or the age of legal majority where you live. A minor may make a purchase only with the involvement and consent of a parent or legal guardian.
By placing an order, you represent that you have the legal authority to enter into a binding agreement.

Manipulate prices, promotions, inventory, reviews, or purchase limits; or

We may restrict or terminate access when reasonably necessary to address fraud, security concerns, unlawful activity, or a material violation of these Terms.
3. Customer Accounts
If you create an account, you agree to provide accurate and current information and to keep your login credentials confidential.
You are responsible for activity conducted through your account, except to the extent caused by our failure to use reasonable security measures.
Please contact support@joiedejade.com promptly if you believe your account has been accessed without authorization.
4. Intellectual Property
The Site and its contents are owned by or licensed to joie de Jade and are protected by applicable intellectual-property laws.
Protected materials may include the joie de Jade name and logo, photographs, videos, illustrations, sketches, embroidery artwork, motifs, prints, graphics, product and collection names, packaging, website copy, layouts, and product designs to the extent protected by law.
Using the Site or purchasing a product does not transfer ownership of our intellectual property.
You may not reproduce, modify, distribute, publish, sell, license, commercially exploit, or create derivative works from our protected materials without our prior written permission.
Purchasing a garment does not give you permission to reproduce, manufacture, or commercially copy its embroidery artwork, prints, branding, or other protected elements.
5. Product Information
We make reasonable efforts to describe and display our products accurately. However:
Colors may vary depending on photography, lighting, screen settings, device displays, and dye lots;
Measurements are approximate and may vary slightly;
Model information and styling photographs are provided as general references;
Size and fit guidance does not guarantee a particular fit;
Length and drape may vary depending on height, proportions, body shape, undergarments, and styling;
Natural silk may contain minor slubs, texture, shading, creasing, or other inherent characteristics; and
Hand embroidery, hand-finishing, and artisan techniques naturally create subtle differences between individual pieces.
These natural and handmade variations are part of the individuality of each garment and are not ordinarily considered defects.
This does not limit your rights if an item is damaged, defective, incorrect, materially misdescribed, or materially different from what you ordered.
Please follow the care instructions supplied with each garment. We are not responsible for damage caused by improper cleaning, handling, storage, alterations, ordinary wear, accidents, or failure to follow care instructions.
6. Availability, Prices, and Errors
Our products may be offered in limited quantities, small batches, through preorder, or on a made-to-order basis. Adding an item to your cart does not reserve it or guarantee availability.
We may limit quantities or decline orders that appear to be placed for unauthorized resale or other commercial purposes.
Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, duties, and other disclosed fees will be calculated during checkout.
Promotions may be subject to separate terms, expiration dates, exclusions, and purchase requirements. Unless otherwise stated, promotions cannot be combined, transferred, redeemed for cash, or applied retroactively.
The Site may occasionally contain an error relating to a description, image, price, promotion, production estimate, or availability. If a material error affects your order, we may offer you the choice to proceed using the corrected information or cancel the affected item for a full refund.
We will not charge a higher corrected price without first notifying you and obtaining any consent required by law.
7. Orders and Payments
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order.
We may accept an order by confirming acceptance or production, beginning production of a made-to-order or customized item, or shipping an in-stock item.
We may decline or cancel an order because of:
Product unavailability;
Incorrect pricing or product information;
Inability to verify payment, billing, identity, or shipping information;
Suspected fraud or unauthorized payment activity;
Violation of a purchase limit;
Unauthorized resale activity;
A technical error;
An inability to fulfill a customization; or
A shipping destination we do not service.
If we cancel an order after collecting payment, we will refund the canceled amount.
By submitting a payment method, you represent that you are authorized to use it and authorize us and our payment providers to charge the total shown at checkout.
Payments may be processed by third-party providers and may be subject to authorization, identity verification, fraud screening, and the provider’s terms.
8. Preorders and Made-to-Order Products
Products identified as preorder, made to order, produced to order, or by a similar description may not be available for immediate shipment.
The product page or checkout disclosure will provide an estimated production or shipment timeframe. By placing the order, you acknowledge that timeframe.
Production times may vary because of hand embroidery, hand-finishing, material availability, or individual production.
If we cannot ship within the timeframe represented at purchase, we will provide any revised estimate, delay notice, consent request, cancellation opportunity, or refund required by applicable law.
Being made to order does not, by itself, make a product final sale. Return eligibility is governed by the product-specific disclosure and our Returns & Refunds Policy.
9. Customized Products
We may offer custom silk colors, embroidery colors, garment lengths, measurements, alterations, placements, or other special details.
A product will be treated as customized, altered, made to measure, or final sale only when that status is clearly disclosed before purchase.
You are responsible for reviewing and approving all requested specifications. Digital images and small swatches may not perfectly represent the finished color or appearance of silk, and handwork may create natural variations.
Customized products may not be changed or canceled after fabric has been cut, materials have been allocated, embroidery has begun, or production has otherwise started.
Unless otherwise stated or required by law, customized, altered, and made-to-measure products are not eligible for return or exchange.
This restriction does not apply if an item arrives damaged, defective, incorrect, or materially inconsistent with the approved specifications.
10. Changes, Cancellations, Shipping, and Returns
Requests to change or cancel an order should be sent promptly to support@joiedejade.com. We cannot guarantee that an order can be changed or canceled after submission, especially after processing or production has begun.
Shipping destinations, costs, estimates, duties, address requirements, and lost or damaged package procedures are governed by our separate Shipping Policy.
Return eligibility, deadlines, item-condition requirements, return shipping, refunds, customized products, and damaged or incorrect orders are governed by our separate Returns & Refunds Policy.
Product-specific restrictions will be disclosed before purchase. Final-sale or return-restricted language does not eliminate rights available for an item that arrives damaged, defective, incorrect, or materially misdescribed.
11. Privacy and Communications
Our collection and use of personal information are described in our Privacy Policy.
We may send order confirmations, production updates, shipping notices, account alerts, return communications, and other transactional messages electronically.
You may separately choose to receive promotional emails. Marketing consent is not a condition of purchase, and you may unsubscribe using the link in a promotional email.
Any SMS marketing program will be voluntary and subject to separate mobile-message terms.
12. Third-Party Services
Our store may be hosted by Shopify Inc. and may use third-party payment processors, shipping carriers, analytics services, social-media platforms, and marketing providers.
Independent third-party services may be governed by their own terms and privacy practices. We are not responsible for the content, security, or availability of websites we do not control.
13. Accessibility
We are committed to providing an accessible online experience.
If you experience difficulty accessing the Site, reviewing product information, or completing a purchase, please contact support@joiedejade.com. We will make reasonable efforts to provide assistance or an accessible alternative.
14. Disclaimers and Liability
To the fullest extent permitted by law, the Site and its digital content are provided on an “as available” basis. We do not guarantee that the Site will always be uninterrupted, secure, current, or error-free.
This does not eliminate an express product promise, our obligation to provide products that materially conform to their descriptions, or any consumer right that cannot lawfully be excluded.
To the fullest extent permitted by law, joie de Jade and its owners, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or a purchase.
To the fullest extent permitted by law, our total liability relating to a particular product or order will not exceed the amount paid for the product giving rise to the claim.
These limitations do not apply to liability that cannot legally be excluded, including liability arising from fraud, willful misconduct, gross negligence, certain personal injuries, or violation of nonwaivable consumer rights.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. This does not deprive you of mandatory consumer protections that apply in your state of residence.
Before filing a formal legal action, you and joie de Jade agree to make a good-faith effort to resolve the dispute informally.
Please send a description of the issue and requested resolution to support@joiedejade.com. We will make a reasonable effort to respond within thirty days.
Either party may bring an eligible individual claim in small-claims court. Nothing in these Terms limits your right to contact a government agency, file a consumer complaint, or exercise a right that cannot legally be waived.
16. General Terms
These Terms, together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and product-specific disclosures, constitute the agreement between you and joie de Jade regarding the Site and your purchases.
If a product-specific disclosure conflicts with these general Terms, the more specific disclosure presented before purchase will govern unless applicable law requires otherwise.
If a provision is found invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision does not waive our right to enforce it later.
We are not responsible for delays caused by circumstances outside our reasonable control. If those circumstances materially delay an order, we will provide any notice, cancellation option, consent request, refund, or other remedy required by law.
We may update these Terms by posting a revised version on the Site. Changes will not retroactively alter the terms governing an order already accepted unless required by law.
